ALIBI VIDEO PLAYER IS A MEDIA PLAYER APPLICATION ONLY. WE DO NOT PROVIDE, HOST, STORE, SELL, DISTRIBUTE, PROMOTE, OR MAKE AVAILABLE ANY MEDIA CONTENT, IPTV SUBSCRIPTIONS, STREAMING SERVICES, CHANNELS, PLAYLISTS, OR LINKS TO CONTENT. USERS MUST PROVIDE THEIR OWN LEGALLY-OBTAINED CONTENT THROUGH LOCAL FILES STORED ON THEIR DEVICE, CONTENT FROM THEIR LOCAL AREA NETWORK (LAN), PLAYLISTS, OR STREAMING URLs.

WE DO NOT ENDORSE THE STREAMING OF COPYRIGHT-PROTECTED MATERIAL WITHOUT PERMISSION OF THE COPYRIGHT HOLDER. WE ARE NOT AFFILIATED WITH ANY THIRD-PARTY IPTV SERVICES OR CONTENT PROVIDERS. WE ACT EXPEDITIOUSLY ON ANY COPYRIGHT COMPLAINT AND MAY SUSPEND OR TERMINATE YOUR ACCOUNT FOR VIOLATIONS OF THESE TERMS.

WE ARE A TECHNOLOGY PROVIDER, NOT A CONTENT PROVIDER. YOU ARE SOLELY RESPONSIBLE FOR THE LEGALITY OF ALL CONTENT YOU ACCESS THROUGH THIS APPLICATION.


Please read these Terms of Service ("Terms," "ToS," or "Agreement") carefully before using the Alibi Video Player mobile application (the "App" or "Services") operated by Alibi Group Limited, a company incorporated in Hong Kong ("us," "we," "our," or "Company").

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

BY ACCESSING OR USING THE APP, OR BY CLICKING "I AGREE" OR A SIMILAR BUTTON, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DISAGREE WITH ANY PART OF THE TERMS, THEN YOU MAY NOT ACCESS OR USE THE APP.


1. Introduction and acceptance of terms

1.1. What Alibi Video Player is

Alibi Video Player is a client-side video player application that allows you to play video content from various sources that YOU provide, including:

  • Local files stored on your device(s)
  • Content from your Local Area Network (LAN)
  • Streams via Xtream Codes API credentials that you enter
  • M3U URL playlists that you add

The App is purely a playback tool. We do NOT:

  • ❌ Provide any content, channels, or streams
  • ❌ Host or store any media files on our servers
  • ❌ Operate backend servers for streaming content
  • ❌ Have partnerships with IPTV service providers
  • ❌ Pre-load any content sources, links, or playlists
  • ❌ Recommend or endorse any third-party services
  • ❌ Have control over what content you choose to access
  • ❌ Monitor, inspect, or log the URLs or content sources you enter

1.2. Technical architecture and privacy

Alibi Video Player operates with a privacy-first architecture. Users can access content from local files on their device(s), their Local Area Network (LAN), or by manually providing or configuring third-party URLs, playlists (M3U), or external service credentials (Xtream Codes API). The App only performs transient, local buffering necessary for playback on your device(s). We have no editorial control over content from any source, cannot intercept streams, and do not monitor what you watch.

Privacy and data collection:

Your privacy is important to us. We collect only the minimal data necessary to provide core App functionality such as authentication, subscription management, and (for MULTI DEVICE users who enable it) encrypted cross-device synchronization.

Key privacy commitments:

  • We do not collect, log, or analyze the URLs or content sources you enter*
  • We do not monitor, inspect, or record what content you access or stream*
  • We do not store, host, or have access to any media content files
  • All content connections are made directly from your device(s) to third-party sources
  • Media streams do not pass through our servers

*NB: For MULTI DEVICE users who enable sync, synced data such as playlists and viewing activity are encrypted before transmission and remain encrypted on our servers; we cannot access this encrypted data.

Because we neither host nor control the underlying content or network infrastructure, and because our commitment to user privacy prohibits us from inspecting, monitoring, or logging any content sources, URLs, endpoints, or streams (whether from local files, LAN, or external sources) entered or accessed by end-users, we cannot block or remove any streams or content sources. The relevant content provider, service operator, or ISP remains the proper entity for content takedowns or access control.

1.3. Subscription model

We offer a limited free trial, after which a subscription is required for unlimited usage. We offer two subscription types:

  • SINGLE DEVICE: For use on a single device with purely local operation. All app operations are local to your device with no cross-device synchronization capability.

  • MULTI DEVICE: For use across multiple devices (up to the limit specified at purchase) with optional encrypted cross-device synchronization. When sync is enabled, your app settings, playlists, watch progress, and preferences are synchronized across all your linked devices using end-to-end encryption.

Our revenue is derived from providing a versatile and robust media player experience that adheres to all applicable laws and regulations, NOT from providing access to any content.

1.4. Important definitions

"Your Device(s)" or "Linked Device(s)": For MULTI DEVICE subscriptions, "your device(s)" and "device(s) linked to your subscription" collectively refer to all devices associated with your subscription account, up to the limit specified at purchase. You are equally responsible for all activity on every linked device as you are for your primary device.

"Content You Access": Refers to all content accessed through the App on any device linked to your subscription, regardless of who physically operated the device(s).

"Your Use": Includes your personal use and the use of any person to whom you have granted access via a linked device on your subscription.

Note on terminology: Throughout this document, references to "your device(s)" or "the device(s)" include all devices linked to your subscription for MULTI DEVICE users, unless otherwise specified.

1.5. Acceptance and revisions

By accessing, browsing, or otherwise using the App, or by clicking "I Agree" or a similar button, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you are agreeing to these Terms for that organization and representing that you have the authority to bind that organization to these Terms. In that case, "you" and "your" will refer to that organization.

We may revise these Terms from time to time. The most current version will always be available within the App and on our website at https://alibi.video/terms-conditions. We will provide at least 30 days' notice of any material revisions by posting the updated Terms in the App or on our website, and/or by sending an email to the address associated with your account. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the App and, if applicable, delete your account.


2. User responsibilities and legal compliance

2.1. Your sole responsibility for content

YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ALL CONTENT THAT YOU CHOOSE TO ACCESS, PLAY, STREAM, OR MANAGE THROUGH THE APP ON YOUR DEVICE(S).

You represent, warrant, and covenant that:

  • You have all necessary rights, licenses, authorizations, and permissions to access and play any content using the App
  • All content you access is legally obtained and you have proper authorization from copyright holders
  • You will not use the App to access any unauthorized, illegal, or infringing content
  • You understand that unauthorized streaming of copyrighted content is illegal under applicable laws
  • You will only use the App for lawful purposes and in compliance with all applicable laws and regulations

2.2. Prohibited activities

YOU EXPLICITLY AGREE NOT TO USE THE APP TO:

Copyright and intellectual property violations:

  • Access, stream, store, or distribute any content that infringes upon or violates any intellectual property rights, including copyrights, trademarks, or patents, of any person or entity
  • Circumvent, disable, or interfere with security-related features of any streaming service or content protection measures, including Digital Rights Management (DRM) or technological protection measures
  • Use the App to facilitate unauthorized access to premium channels, pay-per-view content, or subscription services
  • Share, distribute, or provide access to copyrighted content you do not have rights to distribute
  • Input or use credentials for services you are not authorized to access

Illegal activities:

  • Access or distribute content that is illegal, unlawful, or promotes illegal activities
  • Use the App in any manner that violates any applicable local, state, national, or international law or regulation
  • Engage in any activity that could result in civil or criminal liability under applicable laws
  • Use the App to facilitate any fraudulent, deceptive, or misleading activity

Harmful or objectionable content:

  • Access or distribute content that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
  • Access or distribute content depicting or promoting violence, child exploitation, or any illegal activity
  • Access or distribute content that violates any person's right of privacy or publicity

Technical misuse:

  • Attempt to gain unauthorized access to any portion of the App, other accounts, or any systems or networks connected to the App
  • Use any automated means, bots, or scrapers to access the App or collect information from it
  • Interfere with or disrupt the App or servers or networks connected to the App
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
  • Modify, adapt, or create derivative works based on the App or any portion thereof
  • Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices from the App
  • Use the App to develop, distribute, or operate competing products or services

2.3. ⚠️ Copyright warning

UNAUTHORIZED STREAMING OR ACCESS TO COPYRIGHTED MATERIAL IS ILLEGAL AND MAY RESULT IN:

  • Civil lawsuits and substantial financial damages (up to $150,000 per work under U.S. law; similar penalties apply in other jurisdictions)
  • Criminal prosecution including fines and imprisonment
  • Immediate termination of your Alibi Video Player account without refund
  • Legal liability for copyright infringement claims
  • Permanent account termination under our repeat infringer policy

Alibi Group Limited takes copyright infringement seriously. We strictly prohibit use of the App to access unauthorized copyrighted content. Any such use constitutes a material breach of these Terms and will result in immediate account termination and potential legal action.

You understand that simply using a VPN or similar technology does not make unauthorized access to copyrighted content legal.

2.4. Content sources (Local files, LAN, Xtream Codes API / M3U URLs)

The App allows you to access content from various sources including local files on your device(s), content from your Local Area Network (LAN), third-party sources via Xtream Codes API credentials, or M3U URL playlists. These features are provided for legitimate purposes ONLY, such as:

  • Playing legally obtained personal media from your own servers
  • Accessing content for which you have explicit rights and authorizations
  • Connecting to legitimate IPTV services provided by licensed telecommunications companies or your ISP
  • Accessing content from services you have valid paid subscriptions to
  • Playing your own recorded or created content

WE DO NOT ENDORSE, FACILITATE, AUTHORIZE, OR CONDONE COPYRIGHT INFRINGEMENT OR ANY OTHER ILLEGAL ACTIVITY.

ANY USE OF THE APP TO ACCESS UNAUTHORIZED COPYRIGHTED MATERIAL, WHETHER FROM LOCAL FILES, LAN, STREAMING SOURCES, OR ANY OTHER MEANS, ON YOUR DEVICE(S), IS STRICTLY PROHIBITED AND VIOLATES THESE TERMS OF SERVICE.

We make no warranties or representations regarding the legality, accuracy, quality, safety, or reliability of content from any source, including local files, LAN content, or user-provided external sources. You acknowledge and agree that we have no control over and cannot verify the legality of content you choose to access through the App.

2.5. No affiliation with third-party services

Alibi Video Player is not affiliated with, does not endorse, does not verify, and does not have control over any third-party content providers, IPTV services, broadcasters, networks, streaming services, or content sources. We do not recommend, certify, monitor, or take responsibility for any content, services, or sources that users may access through the App.

All trademarks, service marks, logos, and brand names displayed through user-provided sources are the property of their respective owners. Our App's ability to play content from these sources does not imply any partnership, endorsement, or authorization from these entities.

2.6. Age restrictions and account responsibility

Subscription and Contract Formation:

You must be at least the age of majority in your jurisdiction to purchase a subscription to the App, as subscriptions constitute legally binding contracts. By subscribing, you represent and warrant that you have the legal capacity to enter into this agreement.

Use by Minors:

While the subscription holder must be of legal age, the App may be used by minors (persons under the age of majority) under the following conditions:

  • Minors may only use the App under the direct supervision and permission of a parent or legal guardian who holds an active subscription
  • The account holder is solely and exclusively responsible for:
    • All activity on their account and any linked device(s) (for MULTI DEVICE subscriptions)
    • Monitoring and controlling what content minors access through the App
    • Ensuring minors use the App in compliance with these Terms
    • Any violations of these Terms by minors using device(s) linked to their subscription
  • Parents and guardians acknowledge that this is a media player application that can access any content the user chooses to load, and they are responsible for implementing appropriate parental controls and supervision

MULTI DEVICE Subscription Responsibility:

For MULTI DEVICE subscriptions, you acknowledge and agree that:

  • You are liable for all device(s) linked to your subscription, regardless of who uses them
  • You are responsible for all content accessed on any linked device(s)
  • You are responsible for ensuring that any minors using linked device(s) do so under appropriate supervision
  • Any violation of these Terms on any linked device(s) is attributed to you as the account holder
  • You may be held liable for copyright infringement or other violations occurring on any device(s) linked to your subscription

Account Security:

As the account holder, you are responsible for maintaining the confidentiality of your account credentials and for restricting access to your account and linked device(s). You agree to accept responsibility for all activities that occur under your account.


3. Intellectual property rights

3.1. Our intellectual property

The App and its original content, features, and functionality are and will remain the exclusive property of Alibi Group Limited and its licensors. The App is protected by copyright, trademark, patent, trade secret, and other intellectual property laws of Hong Kong and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Alibi Group Limited.

3.2. License to use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and install a copy of the App on a mobile device or computer that you own or control and to run such copy of the App solely for your own personal, non-commercial use.

You may NOT:

  • Modify, copy, or create derivative works of the App or its materials
  • Use the App or materials for any commercial purpose, or for any public display (commercial or non-commercial)
  • Attempt to decompile, reverse engineer, or disassemble any software contained within the App
  • Remove any copyright, trademark, or other proprietary notations from the App or materials
  • Transfer the App or materials to another person or "mirror" the materials on any other server
  • Use the App in any manner that could disable, overburden, damage, or impair the App
  • Rent, lease, lend, sell, redistribute, or sublicense the App
  • Use the App to develop, test, or operate competing products or services
  • Use the App in any way that violates these Terms or applicable law

Any unauthorized use of the App terminates the license granted by these Terms.

3.3. User-generated content and feedback

If you submit feedback, suggestions, comments, or ideas for improvements to the App ("Feedback"), you grant us a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sublicensable, and transferable license to use, reproduce, publicly display, distribute, modify, and otherwise exploit the Feedback for any purpose, including improving and promoting the App.

You represent and warrant that you have all rights necessary to grant the foregoing license and that your Feedback does not infringe or violate any third-party rights.


4. Accounts and subscriptions

4.1. Account creation and security

To access certain features of the App, you may need to create an account. You agree to:

  • Provide accurate, complete, and current information during the registration process
  • Update such information to keep it accurate, complete, and current
  • Maintain the security of your password and accept all risks of unauthorized access to your account
  • Notify us immediately upon becoming aware of any breach of security or unauthorized use of your account via https://alibi.video/support
  • Not share your account with others or allow others to access your account
  • Not use another person's account without permission
  • Not create an account using false or misleading information
  • Not create multiple accounts to circumvent subscription limitations

You are fully responsible for all activities that occur under your account, regardless of whether such activities are authorized by you. We reserve the right to suspend or terminate accounts created with false information or in violation of these Terms.

4.2. Subscription types

The App offers a limited free trial. After the trial period, unlimited usage requires a paid subscription. We offer two subscription types:

SINGLE DEVICE subscription

Features:

  • Use on a single device
  • All app operations are local to your device
  • No cross-device synchronization capability
  • Full playback features for all supported formats

Restrictions:

  • Attempting to use a SINGLE DEVICE subscription on multiple devices simultaneously may result in access restrictions or account suspension
  • Subscription is non-transferable

MULTI DEVICE subscription

Features:

  • Use across multiple devices linked to your subscription (up to the limit specified at purchase)
  • Optional encrypted cross-device synchronization of app settings, playlists, watch progress, and preferences
  • Seamless experience across all your devices
  • All features of SINGLE DEVICE subscription

Privacy note: For MULTI DEVICE subscriptions with sync enabled, your data is protected with end-to-end encryption. We cannot access, view, or decrypt your synced content. See Section 4.7 for important limitations.

4.3. Payment processing

All payments are processed by trusted third-party payment processors:

  • Apple App Store: For iOS app purchases
  • Google Play Store: For Android app purchases
  • Paddle: For web-based purchases

We do not process, handle, or store your payment card information. Payment data is subject to Apple's, Google's, or Paddle's respective privacy policies and terms of service. For more information, see our Privacy Policy at https://alibi.video/privacy-policy.

4.4. Subscription terms and payment

Subscription terms:

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • The renewal charge will be at the then-current subscription rate
  • You can manage and cancel subscriptions through your Apple App Store, Google Play Store account settings, or Paddle account
  • Cancellation takes effect at the end of the current billing period; you retain access until the end of the paid period
  • No refunds or credits for partial subscription periods, except as required by law or specified in our Refund Policy
  • We reserve the right to change subscription pricing with at least 30 days' notice

Platform-specific subscription management:

  • Apple App Store: Manage via iOS Settings → [Your Name] → Subscriptions
  • Google Play Store: Manage via Google Play Store app → Menu → Subscriptions
  • Paddle: Manage via customer portal link provided in purchase confirmation email

4.5. Refunds and cancellation

Refund policies vary by purchase platform and are subject to platform-specific requirements.

Platform-specific refund procedures:

  • Apple App Store purchases: All refund requests must be submitted directly to Apple through reportaproblem.apple.com. We cannot directly process iOS refunds. Apple has sole discretion over refund decisions.

  • Google Play Store purchases: For purchases within 48 hours, request refunds directly through Google Play. After 48 hours, submit requests to us via alibi.video/support.

  • Paddle (web) purchases: Request refunds through the Paddle customer portal (link in your purchase confirmation email) or contact us via alibi.video/support.

General refund eligibility:

  • 14-day no-questions-asked refunds (Google Play and Paddle only)
  • Technical issues covered anytime on all platforms
  • See full details in our Refund Policy

Subscription cancellation: You can cancel your subscription at any time through your platform account settings. Cancellation stops future billing but does not refund the current billing period except as specified in our Refund Policy.

EU users: Your statutory right of withdrawal applies as outlined in our Refund Policy. By providing express consent to immediate access at purchase, you acknowledge that this right is waived for digital content once you begin using the Services.

4.6. Device limits and linking

SINGLE DEVICE subscriptions are restricted to use on a single device. Attempting to use a SINGLE DEVICE subscription on multiple devices simultaneously may result in access restrictions or account suspension.

MULTI DEVICE subscriptions allow use across multiple devices (up to the limit specified at purchase). To link additional devices:

  • Install the App on your new device
  • Sign in with your existing account credentials
  • The device will automatically be associated with your subscription

You can manage linked device(s) through your settings in the App. Removing a device from your account will revoke its access to your subscription. If you reach your device limit, you must remove an existing device before adding a new one.

4.7. ⚠️ Synchronization service limitations (MULTI DEVICE subscriptions only)

IMPORTANT: SYNCHRONIZATION IS NOT BACKUP

If you use MULTI DEVICE subscription with synchronization enabled, please carefully read and understand these critical limitations:

What synchronization means: Synchronization means that changes made on one device are automatically replicated to all other linked devices that also have synchronization enabled.

Synchronization is NOT data backup or protection:

  • Sync is designed for convenience and accessibility across devices
  • Sync is NOT a backup solution
  • If data is deleted or corrupted on one device, that deletion or corruption will sync to ALL devices
  • Sync conflicts may occur and may result in data loss
  • We do not guarantee error-free synchronization
  • We may impose storage limitations on synced data
  • Sync requires internet connectivity; offline changes may conflict

OUR LIABILITY: WE SHALL NOT BE LIABLE FOR ANY LOSS, CORRUPTION, OR UNAVAILABILITY OF YOUR DATA, REGARDLESS OF CAUSE, INCLUDING:

  • User error or accidental deletion
  • Synchronization errors, conflicts, or failures
  • Equipment or software failures
  • Cyber-attacks, malware, or unauthorized access
  • Service modifications, interruptions, or terminations
  • Internet connectivity issues
  • Exceeding storage limits

Service availability:

  • Synchronization is provided "as is" without warranties
  • We reserve the right to modify or discontinue synchronization features with 30 days' notice
  • Synchronization is dependent on third-party cloud infrastructure
  • We do not guarantee continuous availability or any specific performance level

4.8. Value proposition

You acknowledge and agree that the value proposition of this App and its subscription model is its universal media playback capability, advanced features, user experience, and (for MULTI DEVICE) convenience of encrypted cross-device synchronization—NOT access to any illicit streams or unauthorized content. Our revenue through subscriptions is derived from providing a versatile and robust media player experience that adheres to all applicable laws and regulations.


5. Copyright policy and repeat infringer policy

We respect intellectual property rights and respond to clear notices of alleged copyright infringement in accordance with applicable laws, including the Digital Millennium Copyright Act (DMCA), Hong Kong's Copyright Ordinance, and similar laws in other jurisdictions.

5.1. Our role and limitations

CRITICAL UNDERSTANDING: Alibi Video Player is a client-side media player application. We do not host, control, or have access to any content accessed on your device(s). Our privacy-first architecture prohibits us from inspecting, monitoring, or logging user-entered URLs or content sources. Content connections are made directly between users' device(s) and third-party sources.

What this means:

  • We cannot remove content from the internet, third-party servers, or content providers
  • We cannot block or filter specific URLs or streams
  • We have no technical ability to access or control content sources

The proper parties for content takedowns are:

  • The actual content host or server operator
  • The streaming service provider
  • The ISP or network operator
  • The Xtream Codes API provider or M3U playlist host
  • Law enforcement authorities

5.2. Copyright infringement reports

If you are a copyright owner and believe a user is accessing infringing content through our App, you may report this to:

Please include:

  • Description of the copyrighted work
  • Information about the user account (if known)
  • Evidence of alleged infringement (if available)
  • Statement of good faith belief that use is unauthorized
  • Your contact information and signature (physical or electronic)

Upon receipt of valid complaints, we will:

  1. Document the complaint and associate it with the user account
  2. Notify the user within 3 business days
  3. Apply our repeat infringer policy
  4. Respond to the complainant within 5-7 business days regarding action taken
  5. Cooperate with law enforcement as required by law

False complaints: Submitting false or misleading copyright notices may result in civil liability under applicable laws.

5.3. Repeat infringer policy

IN ACCORDANCE WITH THE DMCA AND OTHER APPLICABLE COPYRIGHT LAWS, WE MAINTAIN A POLICY OF TERMINATING ACCOUNTS OF USERS WHO REPEATEDLY INFRINGE COPYRIGHTS.

Three-strike enforcement:

  1. First notice: Warning and educational notice sent to user. User may submit evidence if notice was in error. No account restrictions if valid challenge submitted.

  2. Second notice: Temporary suspension (7-30 days) and final warning. Requirement to acknowledge Terms and copyright policy before reinstatement.

  3. Third notice: Permanent account termination with no refund. User permanently banned from creating new accounts.

Immediate termination: We may immediately terminate accounts for egregious violations without prior warning, including:

  • Sharing or distributing pirated content
  • Operating commercial piracy operations
  • Circumventing technological protection measures (DRM)
  • Multiple simultaneous infringement allegations
  • Evidence of willful copyright infringement

Definition of repeat infringer: A user who has received multiple valid copyright infringement notices without successful challenges. Valid challenges remove previous strikes.

Appeals: Users who believe their account was terminated in error may submit an appeal through https://alibi.video/support within 30 days. Appeals must include:

  • Account email address
  • Explanation of why the termination was in error
  • Supporting evidence or documentation
  • Statement under penalty of perjury that information is accurate

We will review appeals and respond within 30 days. Our decision is final.

Record keeping: We maintain records of copyright notices for a minimum of three years to ensure effective implementation of this policy.


6. User-generated content and feedback

6.1. Feedback and suggestions

We welcome your feedback, comments, and suggestions for improvements to the App ("Feedback"). You may submit Feedback by emailing us at support@alibi.video or through our support portal at https://alibi.video/support.

By submitting Feedback, you grant us a non-exclusive, worldwide, perpetual, irrevocable, fully-paid, royalty-free, sublicensable, and transferable license to use, reproduce, publicly display, distribute, modify, and otherwise exploit the Feedback for any purpose, including but not limited to improving and promoting the App. You represent and warrant that you have all rights necessary to grant this license and that your Feedback does not violate any third-party rights.

6.2. User reviews and public forums

If our site or App includes features for posting reviews, comments, or participating in discussion forums:

Your responsibility:

  • You are solely responsible for any content you post
  • You grant us a non-exclusive, worldwide, perpetual, royalty-free license to use, display, and distribute your public posts
  • You must not post illegal, defamatory, infringing, threatening, abusive, harassing, or objectionable content
  • You must not post spam, advertising, solicitations, or promotional content
  • You must not impersonate any person or entity or misrepresent your affiliation

Our rights:

  • We reserve the right to remove any content at our sole discretion
  • We are not obligated to monitor or review user-generated content
  • We may suspend or terminate accounts for policy violations
  • We may provide user information to law enforcement or third parties as required by law

7. Indemnification

You agree to defend, indemnify, and hold harmless Alibi Group Limited, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and service providers (collectively, the "Indemnified Parties") from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to reasonable attorney's fees, expert witness fees, and court costs) arising from:

  • Your use of and access to the App, including any content you access, stream, store, or play through the App
  • Your violation of any term of these Terms, including any representation, warranty, or covenant
  • Your violation of any third-party right, including without limitation any copyright, trademark, patent, trade secret, other intellectual property right, privacy right, or publicity right
  • Any claim that your use of the App caused damage to a third party, including copyright infringement claims, defamation claims, or privacy violations
  • Any content you submit, post, or transmit through the App, including URLs, playlists, API credentials, or streaming sources
  • Your breach of any law or regulation, including copyright law, criminal law, or any other applicable law
  • Any claims arising from content accessed through URLs, M3U playlists, Xtream Codes API credentials, or other sources you provide

This defense and indemnification obligation will survive termination, modification, or expiration of these Terms and your use of the App.

Indemnification procedure:

  • We will notify you promptly of any claim subject to indemnification
  • You will assume full control of the defense and settlement, provided that you may not settle any claim without our prior written consent
  • We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses
  • You will not admit liability or settle any claim without our prior written consent

This indemnification is in addition to, and not in lieu of, any other indemnities set forth in a written agreement between you and Alibi Group Limited.


8. Disclaimers

THE APP AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

8.1. No warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, RELIABILITY, SECURITY, OR QUALITY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IN SUCH JURISDICTIONS, THE FOREGOING EXCLUSIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS SHALL AFFECT ANY STATUTORY RIGHTS THAT CANNOT BE WAIVED OR LIMITED BY CONTRACT.

8.2. Content and legality disclaimer

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE LEGALITY, ACCURACY, RELIABILITY, QUALITY, SAFETY, OR AVAILABILITY OF ANY CONTENT ACCESSED THROUGH THE APP, INCLUDING CONTENT FROM THIRD-PARTY SOURCES, IPTV SERVICES, M3U PLAYLISTS, XTREAM CODES API SOURCES, LAN SOURCES, OR USER-PROVIDED SOURCES.

YOU ACKNOWLEDGE THAT:

  • All content accessed through the App is at your own risk
  • We have no editorial control over content from any source accessed on your device(s), cannot intercept streams, and do not monitor what you watch
  • You are solely responsible for evaluating the legality and appropriateness of all content you access

8.3. Third-party services and playback

You acknowledge that third-party services (Xtream Codes API providers, M3U playlist hosts, streaming services, payment processors, cloud infrastructure) may be discontinued, modified, or restricted at any time without notice. We are not responsible for the availability, actions, policies, terms, or content of any third-party service. Your use of third-party services is at your own risk and subject to their respective terms and policies.

Playback quality, performance, and user experience depend on numerous factors outside our control, including device capabilities, internet bandwidth, network conditions, and content source quality. We do not guarantee any specific video quality, resolution, audio quality, uninterrupted playback, or compatibility with all content formats.

8.4. Security

While we employ reasonable security measures, we cannot guarantee complete security of your account, data, or communications against all possible threats. You are responsible for maintaining the confidentiality and security of your account credentials, implementing adequate antivirus and security software, regularly backing up important data, and promptly notifying us of any security concerns.

8.5. Sync data loss (MULTI DEVICE subscriptions only)

CRITICAL FOR MULTI DEVICE USERS: Synchronization is NOT backup. If data is deleted or corrupted on one device, that deletion or corruption will sync to all devices. WE SHALL NOT BE LIABLE FOR ANY LOSS, CORRUPTION, OR UNAVAILABILITY OF YOUR DATA, REGARDLESS OF CAUSE.

8.6. User content

We are not responsible for and do not endorse any content accessed, created, stored, or transmitted by users through the App. All content is the sole responsibility of the person who provided or accessed such content. We have no obligation to monitor, screen, or remove any content and disclaim all liability for any harm resulting from your exposure to content through the App.

8.7. Service modifications

We reserve the right to modify, update, suspend, or discontinue the App or any features at any time, temporarily or permanently, with or without notice. We may impose limits on certain features or restrict access to parts or all of the App. We shall not be liable for any modification, suspension, or discontinuance of the App.


9. Limitation of liability

9.1. Exclusion of damages and liability cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALIBI GROUP LIMITED AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING:

  • Loss of profits, revenue, data, or business opportunities
  • Cost of substitute services
  • Business interruption or system failures
  • Data loss, corruption, or sync failures (for MULTI DEVICE subscriptions)
  • Copyright infringement claims related to content you accessed
  • Any damages from use or inability to use the App

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MAXIMUM LIABILITY CAP: Our total aggregate liability shall not exceed the greater of: (a) fees paid by you in the 12 months before the claim; or (b) US$100.

9.2. Sync data loss disclaimer

CRITICAL FOR MULTI DEVICE USERS: Synchronization is NOT backup. If data is deleted or corrupted on one device, that deletion/corruption syncs to all devices. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING SEPARATE BACKUPS. We are not liable for any data loss regardless of cause.

9.3. Basis of bargain and exceptions

These limitations reflect a fair allocation of risk and are essential to our ability to provide the App economically.

Exceptions: Nothing herein limits liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded under applicable law.

Jurisdiction-specific: Some jurisdictions don't allow exclusion of implied warranties or consequential damages. In such cases, limitations apply to the maximum extent permitted by law. Nothing affects your statutory consumer rights.


10. Governing Law and Dispute Resolution

10.1. Governing Law

These Terms are governed by the laws of Hong Kong SAR.

10.2. Mandatory Arbitration and Class Action Waiver

Any dispute arising from these Terms must be resolved through binding individual arbitration administered by the Hong Kong International Arbitration Centre (HKIAC).

Class Action Waiver: You agree that disputes must be brought individually, not as a class action, representative action, or collective proceeding.

EU users: This does not affect your mandatory consumer rights.

10.3. Time Limit

Claims must be filed within one (1) year after arising.


11. Account termination

11.1. Termination by you

You may terminate your account at any time by:

  • Using the "Delete account" feature in the App settings (Settings → Account → Delete Account)
  • Contacting us at https://alibi.video/support

Upon termination:

  • Your access to the App will immediately cease
  • No refunds will be provided for any remaining subscription period, except as required by law
  • Your data will be deleted in accordance with our Privacy Policy within 30 days
  • For MULTI DEVICE subscriptions, all synced data will be deleted within 30 days
  • Transaction records will be retained as required by law (typically 7 years for tax purposes)
  • You may request a data export before deletion via Settings → Export Data

11.2. Termination by us

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms, including violation of prohibited activities
  • Violation of applicable laws or regulations
  • Copyright infringement or repeat infringer status (see Section 5.4)
  • Fraudulent, abusive, or illegal activity
  • Use of the App in a manner that creates risk of harm or legal liability for us or other users
  • Non-payment of subscription fees or payment disputes (including chargebacks)
  • Extended periods of inactivity (more than 24 months)
  • Violation of third-party rights
  • At our sole discretion for any other reason, including business reasons

Immediate termination without warning may occur for:

  • Copyright infringement (third strike or egregious violation)
  • Sharing or distributing pirated content
  • Hacking, unauthorized access attempts, or security violations
  • Use of the App for illegal purposes
  • Fraudulent payment activities
  • Creating multiple accounts to circumvent restrictions

11.3. Effect of termination

Upon termination by either party:

  • All licenses and rights granted to you under these Terms will immediately cease
  • You must immediately cease all use of the App and uninstall all copies from your device(s)
  • We may delete your account and all associated data, except as required by law
  • Sections of these Terms that by their nature should survive termination shall survive, including but not limited to:
    • Ownership provisions (Section 3)
    • User representations and warranties (Section 2.1)
    • Indemnification (Section 7)
    • Disclaimers (Section 8)
    • Limitation of liability (Section 9)
    • Governing law and dispute resolution (Section 10)
    • Data retention obligations (Section 12)
    • Any payment obligations accrued prior to termination

11.4. No refunds upon termination

If your account is terminated for breach of these Terms:

  • You will not be entitled to any refund of unused subscription fees
  • You will remain liable for all fees and charges incurred prior to termination
  • You will remain liable for any damages arising from your breach

12. Privacy and data protection

Your privacy is important to us. The collection, use, storage, and protection of your personal information is governed by our comprehensive Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you acknowledge that you have read and understood our Privacy Policy and agree to the collection, use, and sharing of your information as described therein.

13. Miscellaneous

13.1. Entire agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Alibi Group Limited. If any provision is found unenforceable, the remaining provisions remain in effect.

13.2. Assignment

You may not transfer these Terms without our consent. We may assign these Terms to any successor entity.

13.3. Force majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, internet outages, third-party service failures, cyber-attacks, or government actions.

13.4. Survival

Upon termination, the following sections remain in effect: User responsibilities for acts during the term (Section 2), our intellectual property rights (Section 3.1), indemnification (Section 7), disclaimers (Section 8), limitation of liability (Section 9), governing law and dispute resolution (Section 10), and any payment obligations.

13.5. No waiver

Our failure to enforce any right does not waive that right. Nothing in these Terms limits your statutory consumer rights under applicable law.

13.6. Electronic communications

You consent to receive communications from us electronically via email or in-app notifications.

You understand that unauthorized access to copyrighted content is illegal and may result in civil and criminal penalties, and that we maintain a three-strike repeat infringer policy that may result in permanent account termination
